1. Acceptance of Terms
By accessing and using the services provided by LW Tile Co. ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services Description
LW Tile Co. provides professional tile installation services including but not limited to:
- Bathroom tile installation and renovation
- Kitchen backsplash installation
- Floor tiling for residential and commercial properties
- Custom tile design and installation
- Tile repair and maintenance services
3. Service Agreements
Quotes and Estimates
- All quotes are valid for 30 days from the date of issue
- Quotes are based on the information provided and site conditions at the time of assessment
- Final pricing may vary if project scope changes or unforeseen conditions are discovered
Project Timeline
- Project timelines are estimates and may be affected by weather, material availability, or unforeseen circumstances
- We will communicate any delays promptly and work to minimize disruption
- Client-caused delays may result in additional charges
Materials
- Client is responsible for selecting and purchasing tiles and materials unless otherwise agreed
- We recommend purchasing 10-15% extra materials to account for cuts and future repairs
- We are not responsible for material defects or color variations
4. Payment Terms
- Payment schedule will be outlined in the project contract
- Final payment is due upon project completion and client approval
- Late payments may incur additional charges
- We accept cash, check, and electronic transfers
5. Warranty
We provide a warranty on our workmanship under the following terms:
- 1-year warranty on installation workmanship
- Warranty covers defects in installation, not normal wear and tear
- Warranty is void if modifications are made by others
- Material warranties are provided by the manufacturer
6. Liability and Insurance
LW Tile Co. carries appropriate insurance coverage. However:
- Our liability is limited to the cost of the services provided
- We are not responsible for damage to existing structures due to hidden defects
- Client should notify their insurance company of renovation work
- We recommend removing valuable items from work areas
7. Client Responsibilities
The client agrees to:
- Provide accurate information about the project requirements
- Ensure access to work areas during scheduled times
- Remove personal belongings from work areas
- Provide necessary utilities (water, electricity) during work
- Obtain any required permits (unless otherwise agreed)
- Make timely payments as agreed
8. Cancellation Policy
- Projects may be cancelled with 48 hours notice before start date
- Cancellation after work has begun may result in charges for work completed
- Material costs are non-refundable if materials have been ordered
- We reserve the right to cancel projects due to safety concerns or non-payment
9. Force Majeure
We shall not be liable for any failure or delay in performance under this agreement which is due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott.
10. Dispute Resolution
Any disputes arising from our services will first be addressed through direct communication. If resolution cannot be reached, disputes will be resolved through binding arbitration in British Columbia, Canada, in accordance with the laws of British Columbia.
11. Privacy and Confidentiality
We respect your privacy and will not share your personal information with third parties without your consent. We may take photos of completed work for marketing purposes with your permission.
12. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.
